SCOPE
These General Terms and Conditions (GTC) apply to all deliveries by Fermented Future Xcellence UG (hereinafter referred to as Sans Péché to consumers.
A consumer is any natural person who enters into a legal transaction for a purpose that cannot be predominantly attributed to their commercial or independent professional activity.

CONTRACTUAL PARTNER
The purchase contract is concluded with Fermented Future Xcellence, An der Alster 82, 20099 Hamburg VAT ID: DE457526446, VAT identification number according to §27a
Responsible for the content according to § 55 para. 2 RStV (see address above)

CONCLUSION OF CONTRACT
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to order.
(2) By clicking the "Order with payment" button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email after receiving your order.

RIGHT OF WITHDRAWAL
(1) If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
(2) If you, as a consumer, exercise your right of withdrawal in accordance with Section 4.1, you shall bear the regular costs of return.
(3) In addition, the provisions for the right of withdrawal shall apply as detailed in the following.

CANCELLATION POLICY
RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us,Fermented Future Xcellence UG, An der Alster 82, 20099 Hamburg, of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached sample withdrawal form for this purpose, but this is not mandatory. If you make use of this option, we will immediately send you confirmation of receipt of such a withdrawal (e.g., by email).

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

CONSEQUENCES OF REVOCATION
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

PRICES AND SHIPPING COSTS
(1) The prices stated on the product pages include statutory VAT and other price components.
(2) In addition to the stated prices, we charge a flat rate of €4.90 per order for delivery within Germany. The shipping costs will be clearly stated on the order page.

DELIVERY
(1) Delivery is only within Germany with DHL.
(2) Delivery times may vary depending on the complexity of the order. Any noticeably long delivery times will be indicated on the respective product page.

PAYMENT
(1) Payment shall be made by the chosen medium.

RESERVATION OF TITLE
The goods remain our property until full payment has been made.

DISPUTE RESOLUTION
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts.
